Why do we collect information about you?

1.1 The Data Controller complies with its obligations under the General Data Protection Regulation (hereinafter – GDPR) by collecting and processing your personal data only for clearly defined purposes and legitimate grounds, updating personal data, securely storing and destroying it, not collecting and storing excessive data, and ensuring that appropriate technical and organizational measures are applied for personal data protection.
1.2 You can view the information regarding products sold in the E-shop without creating an account. In this case, the Data Controller collects technical data about the equipment you use (such as equipment model, ID).
1.3 To purchase goods offered in the Data Controller’s E-shop, you can create an account or provide the necessary purchase data each time you buy, i.e., name, surname, email address, delivery address, and phone number.
1.4 By agreeing to this Privacy Policy and submitting your personal information, you confirm that you grant us permission to process your personal data for the purpose of providing you with the goods and services offered in the E-shop.
1.5 We may also process your data, including email address, name, surname, for E-shop marketing purposes.
1.6 The legal basis for the collection and processing of your personal data in the Data Controller’s activities is the agreement concluded with you regarding the use and purchase in the E-shop and/or your freely given, specific, informed, and unambiguous consent to such data collection and processing.

2.0 AGE RESTRICTION
2.1 People of any age who can conclude such purchase transactions may use and purchase food products and soft drinks in the E-shop. If you are under 16 years of age, it is recommended that you consult with your parents and/or guardians before purchasing goods. Alcoholic beverages are sold from the age of 18. An identity document must be presented before collecting the goods.

3.1 By using cookies, we aim to ensure comfortable browsing for you. 4.0 HOW LONG WILL YOUR INFORMATION BE STORED?
4.1 Personal data that we process for any purpose or purposes shall not be kept longer than is necessary for that purpose or purposes.
4.2 In order to provide E-shop services, the data you provide will be stored for 3 (three) years from the moment you provided us with the necessary information or last used our services.
4.3 For marketing purposes, the data you provide will be stored for 2 (two) years from the moment you provided us with the necessary information, or last used our services, or until the moment you opted out of the processing of your data for marketing purposes.
4.4 The cookies mentioned above will be stored for up to 2 years from the moment of the last visit to the website.
4.5 We make reasonable efforts to ensure the security of your personal information. After the relevant data retention period expires, we undertake to destroy the information you provided.

5.0 YOUR RIGHTS
5.1 Except where exceptions are established by the GDPR or relevant laws, you have the following rights related to your personal data:
5.1.1 The right to access your personal data. You have the right to contact the Data Controller with a request in free form to access your personal data. Upon receipt of this request, the Data Controller will provide you with a copy of the information related to you, and will also explain why and how this information is processed.
5.1.2 The right to demand that the Data Controller rectify, supplement, or delete any of your personal data if they are inaccurate or incomplete.
5.1.3 The right to demand that your personal data be deleted when the Data Controller no longer needs to store such data (“the right to be forgotten”).
5.1.4 The right to restrict data processing when you contest the accuracy of the data, the processing is unlawful and you object to the deletion of the data, we no longer need the data for their processing purposes, but they are required for the establishment or exercise of legal claims, or when, after you have objected to data processing, time is required to verify whether the legitimate grounds for processing override the grounds you have indicated.
5.1.5 The right to request that your personal data be provided to you and, if possible, to transmit this data directly to another data controller.
5.1.6 The right to withdraw your consent to the processing of personal data at any time, when the data processing is based on your consent or the existence of a legitimate interest.
5.1.7 The right to object to the processing of your personal data.
5.1.8 The right to lodge a complaint with the relevant data protection authority according to your place of residence or work, as well as according to the location of the Data Controller’s data processing, which is the Republic of Lithuania, or the location of the infringement. In Lithuania, this authority is the State Data Protection Inspectorate.
5.1.9 You have the right to instruct us to stop using your personal information for marketing purposes at any time.
5.1.10 You have the right to object to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
5.2 The relevant actions will be performed no later than thirty (30) calendar days from the date of the request. The provision of information may be performed free of charge no more than once per calendar year.

6.0 THIRD-PARTY SERVICES
6.1 The Data Processor ensures the security of your personal data; the suitability of its systems and operations is confirmed by relevant ISO standards and recognized in the European Union.
6.2 Your personal data will be kept strictly confidential and will only be provided to service providers who have concluded agreements with the Data Controller. The information we disclose to the third parties listed below is not excessive given the services provided by these third parties:
6.2.1 In order for the Data Controller to deliver the goods you ordered, it engages third parties—couriers—who provide goods delivery services. For the purpose of goods delivery, the Data Controller transmits the following personal data to the couriers: name, surname, phone number, email address, and goods delivery address.
6.2.2 In order to make payments for your submitted orders, you use third-party payment services and provide data to the respective persons providing payment services. After making payments, the Data Controller only receives information confirming that your payment has been made.
6.2.3 In order to send you newsletters, we use a professional newsletter sending platform “Mailerlite” provided by third parties.
6.3 Our Privacy Policy is only valid when you manage and use the E-shop. If you leave the E-shop or are redirected to third-party services, e.g., the payment section, our Privacy Policy will no longer apply to you.
6.4 We are in no way responsible for the content of other parties’ websites or applications.

7.0 DISCLOSURE OF INFORMATION
7.1 We strive to ensure that the information provided to us remains confidential, and therefore, under normal use of the E-shop, we are not entitled to disclose your personal data to other data recipients if it is not necessary for the proper implementation of the Data Controller’s services or the protection of legitimate interests.
7.2 If you violate the terms of use of the E-shop or if we are required to do so by law, we have the right to disclose information about you to competent authorities. We may disclose your personal data to professional advisers as reasonably necessary to obtain professional advice, examine or defend legal disputes, both in court proceedings and in administrative or non-judicial procedures.

8.0 CHANGES TO THE PRIVACY POLICY
8.1 We reserve the right to change this Privacy Policy at any time without prior notice. Any new changes take effect from the moment they are published in the E-shop, so you should review it regularly.
8.2 If this Privacy Policy is updated, we will send you a notification by email.
8.3 If we seek to use your personal data for a new purpose not covered by this Privacy Policy, we will provide a notice explaining this new use, specifying the relevant purposes and processing conditions before commencing the new processing activities. Where necessary, we will seek to obtain your prior consent for the new use of personal data.

9. DISPUTE RESOLUTION
9.1 Any dispute related to the Data Controller, its services, and the operation of the E-shop is resolved through negotiations between you and the Data Controller by contacting the email address info@vesmedica.eu.
9.2 Given that data processing is carried out in Lithuania, the State Data Protection Inspectorate of the Republic of Lithuania is considered the responsible supervisory authority.
9.3 If the dispute goes to court, the laws of the Republic of Lithuania will apply, and the dispute will be heard by a competent court of the Republic of Lithuania.
